Copyright and Intellectual Property Policy

10000090921 ONTARIO INC., doing business as "SAYYARA" (the "Company", "we", "us", or "our") respects the intellectual property rights of others and expects users of our automotive service management platform ("Services") to do the same. This Copyright and Intellectual Property Policy ("Policy") explains how we respond to allegations of copyright infringement and other intellectual property violations.
This Policy complies with the U.S. Digital Millennium Copyright Act (DMCA), Canada's Notice and Notice Regime under the Copyright Act, and other applicable intellectual property laws in jurisdictions where we operate.
Zero Tolerance Policy:
We have a zero-tolerance policy for copyright infringement and intellectual property violations. Users who repeatedly infringe upon intellectual property rights will have their accounts suspended or terminated.
1. Intellectual Property Rights
1.1 Company-Owned Intellectual Property
- The Sayyara platform, including all software, technology, user interfaces, designs, logos, trademarks, and content, is owned by 10000090921 ONTARIO INC. (d/b/a "SAYYARA") and protected by intellectual property laws.
- Users are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with our Terms of Service.
- Users may not copy, modify, distribute, sell, or lease any part of our intellectual property without written permission.
1.2 User-Generated Content
- Users retain ownership of content they create and upload to the platform, including business information, vehicle photos, service descriptions, and reviews.
- By uploading content, users grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content as necessary to provide the Services.
- Users represent and warrant that they own or have the necessary rights to all content they upload and that such content does not infringe upon third-party rights.
2. DMCA Compliance (United States)
2.1 DMCA Takedown Notices
If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to have been infringed, or if multiple works, a representative list
- Identification of the infringing material and information sufficient to locate it on our platform
- Your contact information, including address, telephone number, and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, agent, or law
- A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
2.2 DMCA Counter-Notices
If your content was removed due to a DMCA takedown notice and you believe the removal was in error, you may submit a counter-notice containing:
- Your physical or electronic signature
- Identification of the removed content and its former location
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Your contact information and consent to jurisdiction of federal court
- A statement that you consent to service of process from the person who submitted the takedown notice
3. Canada Notice and Notice Regime
3.1 Canadian Copyright Notices
Under Canada's Notice and Notice Regime, copyright owners may send notices of alleged infringement that we will forward to the relevant user. Valid notices must include:
- The claimant's name, address, and contact information, including email address and telephone number
- Details of the copyrighted work alleged to be infringed, including title and registration information if applicable
- The location of the alleged infringing content (URL or platform location)
- Details of the alleged infringement, including date and time if known
- A statement that the claimant has a good faith belief that the use is not authorized
- A statement that the information provided is accurate
3.2 Notice Processing
- We will forward valid notices to users within a reasonable timeframe, typically within 48 hours
- Users are responsible for responding appropriately to copyright notices and may choose to remove allegedly infringing content
- We retain records of copyright notices as required by Canadian law
4. Repeat Infringer Policy
4.1 Three-Strike Policy
- First Violation: User receives a warning and educational materials about intellectual property rights
- Second Violation: User account may be temporarily suspended for 7-30 days
- Third Violation: User account may be permanently terminated
4.2 Immediate Termination
We reserve the right to immediately suspend or terminate accounts for:
- Egregious copyright infringement involving commercial piracy
- Willful and deliberate intellectual property violations
- Users who attempt to circumvent our detection systems
- Multiple simultaneous infringement complaints
5. Content Protection and Enforcement
5.1 Reactive Handling of Reports
- We do not proactively monitor any user content.
- We respond to valid copyright and IP complaints and may remove or disable access to material pursuant to applicable law (e.g., DMCA, Canada's Notice and Notice).
- We provide plain-language guidance within our legal policies and will respond to intellectual property questions sent to legal@sayyara.io.
- To report suspected infringement, email legal@sayyara.io with the required details described in Sections 2.1 (DMCA) or 3.1 (Canada).
5.2 User Education
- Regular communications about copyright best practices and platform policies
- Clear guidelines on acceptable use of copyrighted materials, including fair use principles
- Resources for understanding intellectual property rights in the automotive industry
6. Other Intellectual Property Rights
6.1 Trademark Protection
- Users may not use trademarks owned by others in a way that causes confusion or implies endorsement
- Business names and logos must not infringe upon existing trademark rights
- We respond to valid trademark complaints following similar procedures as copyright notices
6.2 Trade Secrets and Confidential Information
- Users must not upload or share trade secrets or confidential information without authorization
- Proprietary business processes, customer lists, and pricing information must be protected appropriately
- We will cooperate with investigations involving theft of trade secrets or confidential information
7. Response Procedures
7.1 Notice Processing Timeline
- DMCA Takedown Notices: Content removed within 24-48 hours of receiving valid notice
- Canadian Notices: Forwarded to users within 48 hours of receipt
- Counter-Notices: Processed within 10-14 business days as required by law
- Appeals: Users may appeal copyright decisions within 30 days
7.2 Investigation Process
- All copyright notices are reviewed by trained personnel before action is taken
- We may request additional information or clarification before processing notices
- Users are notified of actions taken against their content with explanation of violations
- We maintain detailed records of all intellectual property complaints and resolutions
8. Safe Harbor Protections
8.1 Platform Liability
- As a technology platform, we qualify for safe harbor protections under applicable copyright laws when we comply with notice and takedown procedures
- We do not review all user-generated content before publication but respond promptly to valid complaints
- Users are solely responsible for ensuring their content does not infringe intellectual property rights
8.2 Good Faith Compliance
- We implement these procedures in good faith to balance intellectual property protection with user rights
- False or bad faith copyright claims may result in counter-claims or legal action
- We reserve the right to terminate users who abuse the copyright reporting system

10. Policy Updates

- Continued use of the Services constitutes acceptance of updated copyright policies
